1. General
These general terms and conditions apply to every offer, treatment, and transaction between Ilse Healing and its associated trade names and a client, to whom Ilse Healing and its associated trade names have declared these terms and conditions applicable, unless explicitly and in writing deviated from by both parties.
2. Efforts of Ilse Healing
- The practitioner of Ilse Healing will perform the treatments to the best of their knowledge and ability and in accordance with the standards of good professional practice.
- The client must ensure that all information reasonably relevant for the proper execution of the treatment is provided to Ilse Healing in a timely manner.
- The practitioner of Ilse Healing is not liable for any damage of any kind arising from acting on incorrect and/or incomplete information provided by the client.
- The practitioner of Ilse Healing will inform the client of the financial consequences of the treatment.
3. Appointments
- The client must notify Ilse Healing of any inability to attend an appointment as soon as possible, but no later than forty-eight (48) hours before the appointment.
- If the client fails to comply with this obligation, Ilse Healing may charge the full fee for the scheduled treatment.
- If the client arrives more than five minutes late for an appointment, Ilse Healing may shorten the treatment accordingly and still charge the full fee.
- If the client arrives more than fifteen minutes late, Ilse Healing may cancel the appointment and still charge the full fee.
- Ilse Healing must also notify the client of any inability to attend an appointment as soon as possible, but no later than forty-eight (48) hours in advance.
- Both parties are exempt from the obligations under sections 3-1 through 3-5 in cases of force majeure. Force majeure is defined according to applicable law and jurisprudence.
4. Personal Data & Privacy
- The client must provide Ilse Healing, before or during the first treatment, with all information deemed necessary by the practitioner or reasonably understood by the client to be necessary for the careful execution of the treatments.
- Ilse Healing records and processes the client’s personal data in a client file, which is then stored in a client database.
- Ilse Healing treats all client information as confidential in accordance with the Dutch Personal Data Protection Act (Wet Bescherming Persoonsgegevens).
- Ilse Healing will not sell or rent client data to third parties without prior written consent from the client.
- Ilse Healing is obliged to maintain confidentiality of all confidential information shared by the client during treatment.
- Information is considered confidential if disclosed by the client or if it is inherently confidential by its nature.
- Confidentiality may be lifted if Ilse Healing is legally required to disclose the information due to law or a court order.
5. Payment
- Ilse Healing states all treatment prices prior to the treatment.
- The listed prices are exempt from VAT.
- Offers in advertisements are valid for the specified duration and/or while supplies last.
- The client must pay for the treatment and any products in cash immediately after the treatment.
6. Liability
- If Ilse Healing is liable, such liability is limited as described in this section.
- Ilse Healing is not liable for any damage arising from reliance on incorrect or incomplete information provided by or on behalf of the client. Ilse Healing is also not liable for damages resulting from the client not following advice or using products incorrectly.
- The skin may react after a treatment. The client is informed of this during the treatment.
- Despite extensive experience with positive results, Ilse Healing cannot guarantee any outcome and accepts no liability for disappointing results of any kind.
- If Ilse Healing is liable for any damage, liability is limited to twice the invoice value of the most recent order, or the portion of the order to which the liability relates, and at all times limited to the maximum payout of professional liability insurance in the relevant case.
- Ilse Healing is only liable for direct damage. Direct damage refers solely to reasonable costs to determine the cause and extent of the damage, insofar as this determination relates to damage under these terms, and reasonable costs incurred to prevent or limit damage, provided the client demonstrates that these costs have limited direct damage. Ilse Healing is never liable for indirect damage, including consequential damage, lost income, missed savings, and business interruption.
- The limitations of liability in this section do not apply if the damage is due to intent or gross negligence of Ilse Healing.
- Ilse Healing is not liable for loss, theft, or damage to personal property brought to the practice by the client.
7. Complaints
- If the client has a complaint about a treatment or product, it must be reported to the owner of Ilse Healing as soon as possible, but within two weeks of discovery, both orally and in writing.
- Ilse Healing must respond adequately to the complaint within five working days.
- If a complaint about a treatment is justified, Ilse Healing will repeat the treatment as agreed, unless it is demonstrably pointless for the client, and the client communicates this in writing.
- If a complaint about products is justified, Ilse Healing will partially or fully reimburse the purchase price.
- If Ilse Healing and the client cannot reach an agreement, the client may refer the dispute to the legal system or a mediator.
8. Damage and/or Theft
- Ilse Healing has the right to claim compensation from the client if the client damages furniture, equipment, or products.
- Ilse Healing always reports theft to the police.
9. Proper Behavior
- Clients must behave according to generally accepted norms in the practice.
- If a client continues improper behavior after repeated warnings, the practitioner has the right to refuse access to the practice without giving further reasons.
- Clients are expected to maintain personal hygiene.
10. Law
- Dutch law applies to every agreement between Ilse Healing and the client.
- Ilse Healing’s general terms and conditions are available digitally and in the practice.
- In the case of interpretation of the content and scope of these terms, the Dutch text is always binding.
- The applicable version is always the most recently published version or the version in effect at the time the agreement was made.
